WHAT DOES THE PROP 65 WARNING I FOUND ON MY SAHARA CASE PRODUCT MEAN?

“This product may contain a chemical known to the State of California to cause cancer and birth defects or other reproductive harm,” is not what you expect to see when you open your new case, bag, or stand. You may even find it alarming. However, if you live in California and look around, you will find this warning on items in your home, restaurants, and even theme parks.

This warning results from a law passed in California in 1986, referred to as the California Safe Drinking Water and Toxic Enforcement Act of 1986, or more generally referred to as “Proposition 65.”

WHY DOES SAHARA CASE INCLUDE THIS WARNING?

Answering this question requires some more context. First and foremost, SAHARA CASE strives to comply with all applicable laws, including Proposition 65. With the way Proposition 65 is structured, however, it is not possible to ascertain, with 100% scientific certainty, whether or not a particular product requires a warning for any one of the more than 850 chemicals on the Proposition 65 list. At the same time, the law allows any private person “in the public interest” – so-called private bounty hunters – to sue companies to enforce the law and keep a percentage of the penalties imposed. These bounty hunters often exploit the law’s lack of certainty about when to warn. They file thousands of Proposition 65 lawsuits every year. Penalties can be very high; the cost of defending a case also is very high.

As a result of the potential penalties and the current private enforcement climate, SAHARA CASE and many other manufacturers have elected to provide the Proposition 65 notice out of an abundance of caution to ensure compliance and avoid the potential for liability. With over 1000 SAHARA CASE products with many sub-assemblies and variations in raw material suppliers, it is not financially possible for us to test and re-test for the 850+ chemicals on the California Proposition 65 warning list, a list that continues to grow every year. The warning does not mean that our products actually will cause any harm. Moreover, a Proposition 65 warning does not imply a product violates any product-safety standards or requirements. The California government has clarified that “the fact that a product bears a Proposition 65 warning does not mean by itself that the product is unsafe.” The government has also explained, “You could think of Proposition 65 more as a ‘right to know’ law than a pure product safety law.” (oehha.ca.gov/prop65/background/p65plain).

We believe our products are not harmful when used as designed. We provide the warning to comply with this California right-to-know law.

I PURCHASED THIS PRODUCT OUTSIDE OF CALIFORNIA; WHY IS IT INCLUDED?

Our products are sold nationwide. It would be challenging and costly to determine which products will be ultimately sold or brought into California. Therefore, to ensure compliance with Proposition 65 requirements, we have decided to include these warnings on all of our products, regardless of destination. 

WHAT IS PROPOSITION 65?

Proposition 65 is a broad law that applies to any company operating in California, selling products in California, or manufacturing products that may be sold in or brought into California. The California Office of Environmental Health Hazard Assessment (OEHHA) mandates that the Governor of California maintain and publish a list of chemicals known to cause cancer, birth defects, or other reproductive harm. The list must be updated at least annually includes a wide variety of chemicals found in many everyday items, such as dyes, solvents, drugs, food additives, by-products of specific processes, pesticides, and tobacco products. The purpose of Proposition 65 is to ensure that people are informed about exposure to these chemicals.

Proposition 65 also requires warnings to be placed on any product, product packaging, or literature accompanying a product that contains or may contain any of the 800-plus chemicals that OEHHA has listed. As noted above, many of the elements listed under Proposition 65 have been routinely used in everyday consumer items for years without documented harm.

A warning must be given if the listed chemical is merely present in a product unless a business demonstrates that the exposure it causes poses “no significant risk.” Concerning carcinogens, the “no significant risk” level is defined as the level calculated to result in not more than one excess case of cancer in 100,000 individuals exposed over a 70-year lifetime. In other words, if you are exposed to the chemical in question at this level every day for 70 years, theoretically, it will increase your chances of getting cancer by no more than 1 case in 100,000 individuals so exposed.

Concerning reproductive toxicants, the “no significant risk” level is defined as the level of exposure that, even if multiplied by 1,000, will not produce birth defects or other reproductive harm. In other words, the level of exposure is below the “no observable effect level,” divided by 1,000. (The “no observable effect level” is the highest dose level which has not been associated with observable reproductive harm in humans or test animals.)

The phone i protected is a galaxy S21 it's an older phone I let the kids watch cartoons and it needed a new screen protector as the last one cracked. I only gave 4 stars because the screen guide that came with my kit has very vague instructions and I was not able to figure out how to use it. Everything else was great. It's cute but there's no world where I'd fork over a whole $50. Luckily it was my first purchase through the Shop app so I paid only $19 for it on promotion. The lettering looks like stickers and the entire thing has a cheap feel to it.. the mouse arrived with a discoloration defect. I'm sure this one's on me, but the setup is battery powered. Thankfully some batteries were included, but I'm not looking forward to switching them out each time they die. Not sure why I thought I purchased a rechargeable set.

Unfortunately, the screen protector did not fit my Apple Watch Series 12 as advertised. SaharaCase’s website specifically listed compatibility with this model, which is why I purchased it. I had verified compatibility beforehand, as SaharaCase was one of the few companies offering a glass-only screen protector rather than a case for the newer Apple Watch. When I installed it, the fit was incorrect and my touchscreen stopped functioning, so I promptly removed it and contacted customer support. Although it took some additional follow-up to get a response, I appreciate that the SaharaCase team worked with me after the fact to resolve the issue and ultimately provide a full refund. While the product didn’t work out for my watch, I’m grateful the team helped reach a satisfactory resolution. I would encourage other buyers to confirm compatibility before purchasing
